To my respected teachers and seniors, colleagues, family, friends and to those who I'm writing to for the first time,
I am sure you are all aware of what happened at the Chief Metropolitan Magistrates Court today. As a student of law, I always wanted to see a court drama, the kind drama that one sees in movies. Well, I unfortunately/fortunately I got that opportunity today. Unfortunately, because the person on trial was my father along with three Professors of the Dhaka University. I say fortunately, because I was a witness to what has become history.
The Government has missed on its opportunity to call off the case against the DU teachers and students. They could have done this via the Public Prosecutor, but they didn't. In fact, they framed charges which implies that they want to see through this case to the very end. The witness to the case will be called in on December 17.
We have also decided to see through this case to the very end. In context of the proposal made by Barrister Mainul Hossain our family has decided not to submit any sort of application or mercy petition to the State asking for forgiveness. My father repeatedly told us to be strong and not to succumb to any sort of pressure. He has ordered us to refrain from making any sort of petitions. At an interview given to a news channel earlier today Barrister Mainul Hossain said that Dr. Anwar has apologized before and they are waiting to see whether he apologizes again by a mercy petition. Well, my answer to that would be, Dr. Anwar apologized after the remand period because he felt that the self respect of a common soldier of the Bangladesh Army had been tarnished. He did it to protect his students from any further harm. He did not forget to mention that just as members of the Armed Forces had self respect, so did the students of the Dhaka University, so did the masses of this nation. That self respect should be kept in tact. Thus, his apology made then, and a mercy now has no relationship whatsoever. Signing a mercy petition now would imply that the teachers have admitted to committing a crime. Thus a mercy petition is out of the question.
A recent development to all this is that a proposal has been made to us by the Vice -Chancellor of the Dhaka University. He told us that he has spoken with the Government authorities and they have suggested that we file for a writ at the High Court tomorrow asking for bail. If we do so, then bail will be granted and the teachers will be set free.
We have chosen to not go forward with this proposal. We are no longer in a position to ask for bail. In fact if we had wanted bail in the first place, we could have filed a writ at the High Court three months ago when all this began. We cannot forget that the present government has released the teachers of the Rajshahi University not by giving them bail. We also cannot forget that it was the Government that promised in National television promising to fully release all teachers and student within two weeks. They never mentioned any proposals of giving a mercy petition or filing a writ at the High Court. It was in context of this promise made by the Government that the Dhaka University Teachers Association called off their program for two weeks.
I conclude saying that we shall not be satisfied with anything short of the Government calling off the cases filed against the teachers and students. We shall not submit a mercy petition, nor shall we file a writ seeking bail. We believe that the Government will act accordingly and do the rightful.
I'm attaching copies of the statement made by my father via my mother made on October 21, 2007. I believe it shall remain as a historical document bearing the essence of 'never say die'.

Dear All,
Todays events at the Court were no different from that of yesterday. The Judge once again framed charges and the four Dhaka University Professors were accused of violating the Emergency Power Rules 2007. At the end of the proceedings the Professors were asked if they pleaded guilty. They did not. The Government yet again missed out on a golden opportunity to drop the case against the academics.
As you can quite clearly see, nothing new. However something did happen today. Something which has rarely happened to me over the past three months. My father after the submissions of the lawyers seeked permission from the Judge to say a few words. His few words ended up as a what I would term it as one of the most historic speeches made in a Court of law. I do not remember all of it but here is what I remember of it of it in English:
"In my 33 years as a teacher of the Dhaka University, I have always held my head up high. There not a single incident which will indicate that I failed as a teacher or as a human being. However, it would not not appropriate to say that there not a 'single' incident. In 1976, I along with my brother Colonel Abu Taher (Bir Uttam) and others were tried by a Special Military Tribunal. My brother was hanged and I was sentenced to jail along with others. That possible because the Special Military Tribunal was not independent one and everyone knew that what was going on was a sham in the name of the law. Well, here I am again before a Court of law another facing trial. The conditions however are very much different. The judiciary of Bangladesh is independent now after years of struggle. The Judge that's stand before me has the opportunity to do what is right. He has been given the independence to give his verdict without intimidation or pressure.
I swear with my hand across my heart that I have not done anything wrong during the incident that sparked off from the Dhaka University. It was my moral duty to extend my hand of support to my distressed students and if if I ever get the opportunity to do it again will. I did it in 1990 during the fall of Ershad, I did it in 2001 when the Police entered Shamshunnahar Hall and beat up our female students. I did it again on August 20, 21, 22 and 23.
Honourable Judge before you make you decision, you cannot forget that not all laws are laws, not not trials are trials. I would like to conclude reciting a poem of Jibanananda Das ( At this point he recited a poem)
The teachers and students of the Dhaka University will not be fed to the vultures and hyenas. (Dhaka Bisshobiddyaloyer kono shikkhok othoba kono chattra shokun or sheyal er khaddo hobe nah) May you do the rightful."
I began to cry after hearring that speech. My tears were not out of weakness, they were from the immense strength that I now possess. I urge you to stay strong. Victory will be ours.
